DMCA / Copyright Takedown Policy

Last updated: August 2, 2026 · Effective: August 2, 2026

This policy applies to OurSpace 2.0 (our-space-vibes.base44.app) and all users worldwide.

1. DMCA Safe Harbor Notice

OurSpace 2.0 respects the intellectual property rights of others and expects users to do the same. In accordance with the Digital Millennium Copyright Act (17 U.S.C. § 512), we maintain a safe-harbor framework that allows copyright owners to request the removal of allegedly infringing content hosted on our Platform.

It is our policy, in appropriate circumstances, to disable and/or terminate the accounts of users who are determined to be repeat infringers of copyright.

2. Filing a Copyright Takedown Notice

If you believe that content on the Platform infringes a copyright you own or control, you (or your authorized agent) may submit a written takedown notice to our designated copyright agent at the address below. Your notice must include the following elements to be valid under 17 U.S.C. § 512(c)(3):

  • A physical or electronic signature of the copyright owner or a person authorized to act on their behalf;
  • Identification of the copyrighted work claimed to have been infringed (or a representative list if multiple works);
  • Identification of the specific material on the Platform that is claimed to be infringing, with enough detail (e.g. the URL) for us to locate it;
  • Your contact information, including your full name, address, telephone number, and email address;
  • A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and
  • A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

Designated Copyright Agent:
OurSpace 2.0 — Legal / DMCA
Email: legal@ourspace.app
Subject line: “DMCA Takedown Notice”

Note: Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing may be subject to liability for damages.

3. How We Process Takedown Requests

Upon receipt of a valid notice, we will:

  • Review the notice for the required statutory elements listed in Section 2;
  • Remove or disable access to the allegedly infringing material expeditiously;
  • Notify the user who posted the content that the material has been removed (or access disabled) and the reason;
  • Record the takedown on the content record (flagged as dmca_takedown_status: removed);
  • Forward the full notice, including the claimant's contact information, to the affected user so they may file a counter-notification if they dispute the claim.

4. Counter-Notification (Disputing a Takedown)

If your content was removed and you believe in good faith that it was removed due to mistake or misidentification, you may file a counter-notification with our copyright agent. A valid counter-notification under 17 U.S.C. § 512(g)(3) must include:

  • Your physical or electronic signature;
  • Identification of the material that was removed and the location at which it appeared before removal;
  • A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification;
  • Your name, address, telephone number, and email address; and
  • A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if outside the United States, any district in which the Platform may be found) and that you will accept service of process from the person who filed the original takedown notice.

If we receive a valid counter-notification, we may restore the material within 10–14 business days unless our copyright agent first receives notice from the original complainant that they have filed a court action seeking to restrain the alleged infringer.

5. Repeat Infringer Policy

In appropriate circumstances, OurSpace 2.0 will disable and/or terminate the accounts of users who are determined to be repeat infringers. We generally consider a user to be a repeat infringer after two (2) valid, uncountered takedown notices within a 12-month period, though we reserve the right to act sooner where the infringement is willful or large-scale.

6. User Content & Licensing Representations

By uploading any media to OurSpace 2.0 — including profile photos, cover images, post attachments, and audio tracks — you represent and warrant that:

  • You own the content, or you hold all necessary licenses, permissions, or rights to use and display it;
  • The content does not infringe the copyright, trademark, or other intellectual-property rights of any third party;
  • You understand that uploading content you do not have rights to may result in removal, account action, and, where applicable, legal liability for you personally.

Each upload interface on the Platform includes a confirmation checkbox reinforcing this representation. We encourage creators to favour original works, properly licensed assets, royalty-free libraries, or embedded third-party players (Spotify, SoundCloud, Apple Music) over direct hosting of audio you do not own.
